I have no problem with him being out of the AFC, but I also look at the Bills WR room and don't worry too much because if you can't rush the passer with 4, you need more than one shut down corner.

If he was released then what’s the trade?

Did NE pull him back off waivers?

Was he even on a waiver list?

I'm not sure but... I think he would have been officially waved at 4pm EDT. It would seem that the Patriots were able to work out a trade prior to that official designation.
