Mar-a-Lago Raid: 11th Circuit Grants Partial Stay of District Court Special Master Order As To Documents Marked Classified

Feds “entitled to a stay of the district court’s order, to the extent that it (1) requires the government to submit for the special master’s review the documents with classification markings and (2) enjoins the United States from using that subset of documents in a criminal investigation.”

 

The 11th Circuit Court of Appeals has granted the feds motion for a partial stay of that portion of the District Court’s Order appointing a Special Master as required the feds to submit approximatly 100 documents with classified markings for review by the Special Master, and prohitibit the feds from using those documents as part of a criminal investigation until review by the Special Master.

Trump can duck special master ask to verify Mar-a-Lago inventory, judge rules

 

Former President Donald Trump doesn’t have to confirm whether the FBI’s list of classified documents and other items seized in last month’s Mar-a-Lago raid is correct before he and his legal team review the haul, a Florida federal judge ruled Thursday. 
 

Special master Raymond Dearie had asked the 45th president’s team to file a declaration or affidavit about the validity of the inventory after Trump claimed that agents may have planted some of the documents removed from his Palm Beach resort during the Aug. 8 operation.

 

But US District Judge Aileen Cannon agreed with the former president’s attorneys, who argued that Dearie’s request overstepped the bounds of Cannon’s order that asked the government for a certified inventory list.

 

“The Court’s Appointment Order did not contemplate [Trump’s] obligation,” wrote Cannon in her six-page ruling, adding that “the parties and the Special Master now are situated to proceed forward with the review process.”

 

Dearie, appointed by Cannon at Trump’s request, had asked the DOJ to issue a detailed inventory list and certify it was full and accurate by this past Monday. 

 

The government complied with an updated list that is roughly the same as its initial inventory showing more than 100 documents marked “CONFIDENTIAL,” “SECRET, or “TOP SECRET” were removed from Mar-a-Lago.

11th Circuit Court Expedites DOJ’s Appeal of Special Master Appointed to Review Trump Documents

 

The 11th Circuit Court will expedite the DOJ’s appeal of a special master appointed to review documents seized at Mar-A-Lago:

Appellant’s “Motion to Expedite Appeal” is granted. The Court directs the Clerk to expedite the appeal for merits disposition purposes.
 

Having consulted with the Chief Judge, the appeal will be assigned to a special merits panel from the classified appeals log randomly selected by the Clerk. That panel will decide when and how to hear oral argument.

President Donald Trump will get back some of the documents the Justice Department seized at Mar-A-Lago, the special master reviewing the documents ordered Friday, though they are limited to documents that aren’t privileged or government materials and the DOJ had already offered to give them back in August.

Supreme Court Denies Trump Application To Vacate 11th Circuit Order On Documents Marked Classified
 

The Supreme Court, in a single sentence decision without any noted dissents, denied Trump’s request to vacate an 11th Circuit ruling that reversed one part of the District Court Order appointing a Special Master. That part of the District Court order prohibited the feds from continuing to use the documents marked “classified” that were seized during the Mar-a-Lago Raid pending review by the Special Master.
 

The rest of the Order appointing the Special Master remains in place pending a separate appeal by the feds to the 11th Circuit. The 11th Circuit ruling had gone out of its way to point out it was limited and did not involve the ultimate merits. From the 11th Circuit Opinion (emphasis added):
