I said this last night and am hearing others on talk repeating it today. You are correct, if he walked out of the White House with his arms full of classified stuff, it is his perfect right since he is still POTUS until Xiden was sworn in.

He declassified a ton of stuff before leaving office. The deep state has sat on those documents and fought their release.

Extremely weak.  Said the same about Hillary - as SecState, she's a declassification authority as well.  The "holding classified docs" argument against her was bullshit as well.

 

Mishandling government records, though, is a serious charge, classified or no.  But again, see all my previous rants about progressive double-standards.

That sounds like theories that are frequenting 4Chan and the like right now.  And Trump will arise from incarceration 3 days later to reveal he is the son of Ronald Reagan and he and Elvis are going to free the galaxy from pedo liberals and their little green allies.

They were suggesting it works for Trump if they don't have good juice on it, and that he had been poised to react quickly to something like this, but I didn't get the sense they genuinely felt he had this planned all along.

As Secretary of State she was declassification authority for anything originating at State

 

SoS cannot declassify documents that originated in another agency.  Nor could SoS declassify documents originating from State that include classified material that originated from another agency without that agency approval.

 

Let's say State prepares a briefing for POTUS that includes the location of US carriers.  State cannot declassify that briefing without approval of the Navy

Actually, not true.  Declassification authority is vested in "whomever the President delegates it to," according to the CFR and original EO.  And he delegated a lot of that authority to the Secretary of State (including a ton of DoD oversight, indirectly through responsibility for treaties.)

At this point in time, what difference does it make? 

 

Hillary's biggest issue wasn't whether she could class docs or not, it was the fact she dealt with state secrets illegally while using a private email and server that was easily hacked and accessed by at least one foreign entity
