The biggest tragedy isn't that the FBI/DOJ did this, but that they were forced to do this by the Greatest Threat to Democracy in History.

On the one hand, this'll turn into a major federal vs. states' rights shitstorm, at the hands of the left.

On the other hand...the same left that passes laws at the municipal level to sever all ties with CBP.

This is going to bring a lot of hypocrisy to light...which, as usual, will be completely ignored.

This is also where several years of "independent" "fact checking" come in to the forefront.  Trump has absolutely no chance for any sort of public defense.

And it's a damn good thing the DHS Department of Misinformation was stillborn, or the upcoming "independent" "fact checking" would be much, much worse.

Also wondering how many of these documents will "conclusively prove" that Republican mid-term candidates were "directly involved" in the "insurrection," and hence somehow ineligible to run.  After the majority of primaries are finished, of course.

Been saying for decades: the Democrats will ban the Republican Party, if given half a chance.  This is how I'd start that.

Deranged Rhino

The moment he got played by part of his “inner” circle re RussiaGate, this became inevitable.

Tomorrow (8/9) is going to be a day to turn off the tv, news, radio, social media’s - it’s going to be insufferable on all sides.

Schaffer will speak of this proof while being unable to share it.

way to take some aggressive action, like now

sending clear message that all future elections will be fraud fests

no way they let the Rs re-take the house, even if it would be for visual entertainment only

I wonder how that would stand up in a constitutional test.  Does that supersede Article 2, Section 1, Clause 5?

I could make an argument either way.  It'd be interesting to see how the courts would rule.

An argument that seems to be dismissed by the NYT's Charlie Savage that is mentioned in this Politico article.

POLITICO Playbook: After the search: GOP torches FBI, hugs Trump

Quote

... There was a burst of excitement on Democratic legal Twitter after MARC ELIAS pointed out that one of the penalties for violating the statute on improper handling of government records is being “disqualified from holding any office under the United States.”

But as NYT’s Charlie Savage expertly explains, that issue was well-ventilated back when conservatives wanted to throw HILLARY CLINTON in jail for allegedly violating the same law, and many scholars concluded that, as applied to a presidential candidate, it’s unconstitutional because the Constitution alone sets the eligibility criteria for the presidency. (Former A.G. MICHAEL MUKASEY was a fan of this theory, but Savage notes that he later recanted.) ...
