So it's okay in your opinion if it's only city elections? Don't answer, I know it's not but that is the problem as I see it... It only effects certain people so it's okay. Just like taxes for instance, if they only raise them on the rich that's okay because it doesn't affect me. Or maybe it's that new law, it's okay because it doesn't affect me...

 

And again, not picking on you, but this is the entire reason we are  purposefully divided in this nation and until we all look to things that affect anyone, as an affront to all of us we will stay divided.

From the start of the pandemic, masking has been a social convention, not a legal one. The constabulary isn’t posted on every corner and in every business checking to make sure your nose and mouth are properly obstructed. When masking was all but universal, it was a result of a social compact that drafted individuals into the policing of their own communities. It was an organic response to a genuine panic around a disease that could not be mitigated pharmaceutically. That is no longer the case.

 

Masking as a social convention has withered away in the parts of the country where pandemic-related apprehension is low, and it cannot be reimposed from the top down. At least, that’s what California’s experience suggests.

 

If New York and California’s governments are making a political statement, their endorsement of burdensome interventions into American social and economic life makes perfect sense. They’re appealing to constituencies that like government mandates and want to see more of them. But their policies are not justified by the existence of a public health crisis; indeed, they’re not even acting like it is a public health crisis. If they were, compliance wouldn’t be left up to the discretion of individuals, business owners, or county executives.

 

But it is, and that should tell you all you need to know

Question for Senator Karen: Just who is responsible for “rigging” the tax code? Oh yeah—that would be Congress. I know Warren was not in the Senate when the tax credits for electric cars were initially passed, but is there any doubt how she’d have voted? Is she supporting the expanded tax credits for electric cars in the so-called “Build Back Better” bill? Well, you know what they say about consistency.

 

P.S. Musk has lately been selling billions of his Tesla stock. Unless he has some large losses somewhere, he’s going to pay hundreds of millions of dollars in capital gains tax this year. I wouldn’t be surprised if his tax bill this year is the largest in U.S. history for a single individual. That won’t stop Senator Karen from saying he isn’t paying his “fair share.” (“Fair share” for a Democrat always means, “more than whatever you’re paying now.”)

Judges in Harvey Weinstein appeal slam 'prejudicial testimony,' raise questions about conviction

 

It's always dangerous to assume what judges will do based on oral argument questioning. However, they do raise a valid point: Was Weinstein convicted because the prosecutors proved he committed the crimes he was accused of beyond a reasonable doubt, or was he convicted because the prosecutors successfully showed he was a piece of shit as a human being?

 

Same issue Cosby had at his first trial (which resulted in a hung jury): the judge allowed only one witness to prior bad acts. At the retrial, the same judge inexplicably allowed multiple accusers to testify about crimes he was never charged with.

Would that not go to character? I know I have heard about character witnesses before but not sure if this is what that would be.

Character witnesses/reputation evidence aren't generally allowed (unless the defense opens the door trying to proclaim the defendant is a good guy).

 

Prior uncharged bad acts can go towards arguing things like the crime wasn't an isolated incident, that the person had a specific way of committing the crime, etc. Cosby, for example, having a history of providing drugs to women before having sex with the can be relevant. However, piling on, like they did with Weinstein and Cosby, is dangerous from an appeal perspective, especially when there's scant evidence that the crime they were charged with actually occurred.

 

The probative value of the evidence must outweigh the prejudice to the defendant. For example, putting in evidence that someone may be a child molester has absolutely nothing to do with proving whether or not a defendant drove drunk.

 

While it's great to try to get a conviction based on the defendant being a vile piece of garbage, the job is to actually prove they committed crime(s) they're charged with.
